It is your responsibility to safeguard the login and password that you use to access the Services and you agree not to share your login and password with any third party. You are responsible for any activity originating from your account, regardless of whether such activity is authorized by you. Notify us immediately of any unauthorized use of your account.

We may choose to modify or discontinue Services, including any portion of the Services as we update our offerings and add more features. You may use this Site only for lawful purposes and in accordance with these Terms of Use. You agree not to use this Site in any way that violates any applicable law or regulation or restricts or inhibits any person’s use or enjoyment of this Site. We have the right to deny you access to this Site, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service

Your voluntary provision to us of your cell phone number represents your consent that we may contact you by SMS or MMS messages at that phone number, your carrier rates may appliy, and your consent to receiving such communications for transactional, operational, or informational purposes. You may unsubscribe from receiving text messages from us at any time by replying “STOP” to text messages. If you need assistance, contact our customer service at 1-855-287-4477. If you unsubscribe from receiving text messages from us, you may continue to receive text messages for a short period while we process your request(s).

You are granting Certified Tracking Solution and our affiliates a royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, translate, publish, display, and redistribute your content. If you delete content, we will use reasonable efforts to remove it from the Site, but you acknowledge that caching or references to the content may not be made immediately unavailable.

Privacy

Indemnification

You agree to indemnify and hold harmless Certified Tracking Solution and its affiliates, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Site and associated Services, including but not limited to any violations these Terms of Service.

Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL CERTIFIED TRACKING SOLUTIONS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. THE LIMITATION OF LIABILITY SET OUT ABOVE DOES NOT APPLY TO LIABILITY RESULTING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Governing Law

Your use of this Site and any dispute arising out of such use of the Site is subject to the laws of Alberta, Canada.
