The Canadian ELD mandate has been in effect since June 12, 2021, with a progressive enforcement period that has been extended to January 1, 2023. This means penalties for non-compliance won’t begin until after January 1, 2023 and Transport Canada will promote education and awareness for truck drivers until then.
The United States already requires full compliance with a certified ELD device as of Dec. 16, 2019.
The mandate aims to improve road safety across Canadian provinces and territories. It requires commercial motor vehicle drivers subject to Hours of Service regulations to use electronic logging devices (ELDs).
An ELD is a device or technology that automatically records a driver’s driving time to better track, manage, share and improve accuracy and efficiency in the driver’s record of duty status.
Transport Canada states that federally regulated carriers are required to migrate into ELD solutions. Currently this translates to over 150K commercial vehicle drivers across Canada.
For the US, the FMCSA (federal motor carrier safety administration) says:
“The ELD applies to most motor carriers and drivers who are currently required to maintain records of duty status (RODS) per Part 395, 49 CFR 395.8(a). The rule applies to commercial buses as well as trucks, and to Canada- and Mexico-domiciled drivers.”
Mandate exemptions include short-term rentals and commercial vehicles operated within a certain radius.
Additionally, there are carriers with other exemptions which have been issued by authorities.
